He did not and Don Yee saying things does not make them true.

The "justification" for length is only necessary because Doty is a NFLPA fanboy and flew in the face of established deference to arbitration decisions. Now that getting the band back together in Minnesota isn't happening, the discretion of the commissioner will be much more likely to carry the weight the CBA gives it.

Just saying he didn't cooperate doesn't make it true either. Wells flat out said that Brady cooperated and answered all of his questions. He just wouldn't give him the stuff on the phone. That all comes straight from Wells' mouth in the statement with the report.

I don't think the word deference means what you think it means.

Yeah, you're kind of a blow hard and it's very off putting, but the important thing is that the Southern District of New York understands its role.

Your particular brand of certainty warrants little deference.

The PED comparison was Goodell's. Has any team ever been fined $1M or lost a first round pick because of a PED?

Florio and Schefter just hammering Mort and pretty much confirming Kensil as the leak of the fake report that started the whole thing. This shit is fascinating theater - who can screw it up the worst?

They are more hammering the leak and the report itself, but that's just so they don't directly piss off Mort.

This was probably the worst shot directly at Mort:

Mike Florio {l Wrote}:Apparently, only 11 of 12 reminders about his WEEI appearance to Chris Mortensen went through.

I just love this one in the comments section:

Wait, what? The Jets cheated? I want draft picks, a million dollars, the kicker suspended, and Woody Johnson has to test to see if the No More Tears shampoo really works on national TV at halftime of the first Monday Night game this year.

Laughable.

Now it has come out that the person conducting the interviews during the appeal of the decision based on Wells Report, including that of Brady himself, was Wells' partner at Paul Weiss, who worked on the report and was on the dais during Wells' press conference regarding its release. You can't make this shit up.

The NFLPA agreed to a really terrible discipline process. So what? It won't matter to Judge Berman. Frankly, if I were Brady's lawyer after getting dressed down for scorched Earth tactics, I'd tell Eli's Bitch to offer to do 3 games--Berman would probably strong arm the NFL into agreeing.

I don't think he cares if it is 3 or 4 or 2. Pats won't go worse than 2-2.

This will go to the end unless the NFL backs down. Brady's only concern from the beginning is his legacy. This has zero to do with how many games he sits and frankly he has little exposure and thus little incentive to settle. The worst he ends up with is the 4 games he already has.

I doubt any of the lawyers are too concerned about the anti-rhetoric rhetoric.

Judge Berman, born in NYC, went to NYU law School, has another degree from Fordham. Great, probably another NY Jets whore like Wells, Kensil, and Goodell and the rest of the NY NFL office. He was appointed by Clinton which means he has no regard for what the law actually says, but only what he thinks it says.

Meh, I'm comfortable assuming I've been following this more closely than everyone on this board (especially Dick who might actually be Mort or Kensil) and Berman seems to be a fairly level headed judge that wants to get the process over as quickly as possible from everything I've read and had people who know what they're talking about explain to me. The link below is a nice discussion about why Pats fans are ripshit about this whole sham.

My favorite are the reports that player reps are angry the NFLPA is spending money defending a cheater. As opposed to the money they spent defending proven abusers of women and children. Which is why they can't have nice things.

He's been all over this one though. Without Florio and the woman from the Washington Post, everyone in the media outside of Boston would be regurgitating the fictions coming out of the NFL headquarters like Mort did.

I believe Florio's deal with PFT was up last year and, as part of his new contract, he demanded, and got, a lot more editorial freedom. So it looks like it's manifesting itself. Sally Jenkins is the WaPo person that's been great as well. Shockingly, Mike Reiss is the only ESPN person to truly express disdain for the whole process and, given the hints he's been mentioning about his displeasure with the way they're handling his blog, I'm curious how much longer he'll be there. I think he's even subtly called out Mort for blowing this retarded thing up as well.

Apparently, there is new evidence that Brady's defense will be presenting at the appeal that the arbitrator refused to review. Specifically, Brady's disdain for deflated things.

Not for nothing, but when you have someone on the record who is clearly lying you ask obvious questions. There is a number of reasons for it: 1) to see exactly how outrageous a lie is being told, 2) to get them to start answering questions truthfully in the hopes it snowballs into truthful statements about the event in question and 3) presenting some misdirection so that the deposed may slip from his coached script.

When it comes to intelligence, I'll take Goodell over the dumb jocks who struggle to hit 30 on the Wonderlic.

Has nothing to do with someone lying, you are always trying to build a clear transcript. Some of the compound questions asked by NFL counsel are incomprehensible with his insatiable need to clarify the intent of his question for the record in the middle of the question. Sometimes you are just stalling for time while you formulate the next line of questions. Sometimes you are expressing incredulity, as HJS suggests, to throw the witness off. Brady may have mumbled and Goodell did not hear but the steno did. What Goodell did happens all the time, although to attribute deposition tactics to an elevated NFL intern is a bit of a stretch.

Goodell is no rocket scientist and Brady got a 33 on the Wonderlic.
