Don't get too excited there, Brady jock-sniffer. The salary reduction is clearly a subterfuge to avoid this penalty. I could see the league disputing the reduction and seeking to enforce the award using the contract numbers in effect at the time of the arbitration decision. Otherwise, everybody will start doing this and the league's disciplinary system will fall apart.


Yeah, no its not. I just said that to get some righteous indignation out of a Philly fan. They did it for the same reason they traded Chandler Jones and the league won't do fuck all about it because it happens all the time. He's only making $1 million the year after, as well.

This is true.

Kraft doesn't give a shit. He's going to do whatever he wants until 1) he is dead or 2) someone has the balls to stand up to him. Kudos to him, but it will be nice when the Patriots return to a level of insignificance.

This may not be over. The Players Association has indicated it is considering "all options". They could file for an "en banc" rehearing in front of every judge before the Second Circuit Court. Granting this is very rare, but Brady lost 2 to 1 and the dissenting judge is the Second Circuit Chief Judge. So far, a total of four judges have heard Brady, two have ruled in favor, and two have ruled against him. So it makes sense to grant him some type of tiebreaker. This would also get Brady another stay of his suspension. It could take until 2017 to arrive at a decision if the court decides to hear it.

Bottom line, Berman disgraced himself and completely ignored the law to try and save Brady and further ingratiate himself with his pal Robert Kraft. The 2nd Circuit quite appropriately stepped in and bench slapped him and Brady's legacy is forever tarnished by his unethical conduct and the fact that there is now considerable suspicion concerning Berman's conduct and his relationship with Kraft.

All kidding aside, I will be very surprised if the 2nd Circuit grants an en banc rehearing. And the "chief judge" of a federal circuit court is more of an administrative role; the position is simply rotated and filled by the most senior judge on the court who has not yet reached senior status, so it's not like he or she has more power than anyone else on the court when it comes to decision making. (Although I know nothing about Judge Katzmann and whether he has particular sway with any other members of the court, but he clearly did not with the other two members of the panel). They will not look at an en banc rehearing as a "tie breaker" either. Circuit court judges are, and view themselves as, being a step above the district court judges, and so the second circuit decision is the final word on this. (Unless the union's lawyers can convince enough second circuit judges that the majority was clearly wrong about the law). And the Supremes will not touch this case.

Parker and Chin are both Democrat appointees, which is the majority in the Second Circus (TM CLB, USDJ RIP). Moreover, Parker is generally considered a bellwether, so I doubt there will be much appetite to reverse him amongst his colleagues.

Brady's only chance is that Chin is a graduate of the FLS diploma mill. It is possible that the Circuit could decide that his Fordhamness disqualifies him from doing anything other than rejecting prisoner habeas petitions and decides that Parker must have been drunk to agree with Denny. Barring that he is screwed.

Looks like Ted Olsen got a 14 day extension to file the en banc. What the hell. If the guy can basically make W the President, he ought to be able to do this.
